Terms of Service

1. Introduction

These Terms of Service ("Terms") govern access to and use of ReVu, a customer experience platform operated by ReVu Systems ("ReVu", "we", "us" or "our").

By accessing ReVu, using our website, requesting a demo, creating an account, using a business dashboard, using a ReVu review link, submitting feedback or otherwise using the platform, you agree to these Terms.

If you are using ReVu on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

2. What ReVu does

ReVu helps businesses:

  • collect customer ratings;
  • capture private feedback from unhappy customers;
  • redirect satisfied customers to Google Reviews;
  • recognise repeat customers;
  • manage loyalty and reward activity;
  • track customer sentiment and engagement;
  • manage SMS or WhatsApp communication credits;
  • view customer, review, marketing and estimated impact dashboards.

ReVu does not own or control Google Reviews, WhatsApp, SMS networks, third-party payment providers or other third-party services.

3. Private beta status

ReVu may be provided during a private beta or controlled launch period.

During private beta:

  • some features may be limited, disabled or manually fulfilled;
  • SMS, WhatsApp or payment integrations may operate in manual or placeholder mode;
  • live sending may be disabled by kill switches;
  • support may be handled manually;
  • features may change as the product improves.

ReVu aims to keep the platform stable, but beta features may change, break, be delayed or be removed.

4. Accounts and access

To access business or admin dashboard features, users may need an account.

You are responsible for:

  • keeping login details secure;
  • ensuring only authorised staff access your dashboard;
  • notifying us if you suspect unauthorised access;
  • providing accurate account information;
  • using the platform lawfully.

We may suspend or restrict access where we suspect misuse, security risk, non-payment, unlawful activity or breach of these Terms.

5. Business responsibilities

Businesses using ReVu are responsible for:

  • ensuring they have the right to use ReVu for their business;
  • ensuring their public review links, logos and business information are accurate;
  • ensuring customer communications are lawful;
  • honouring customer opt-outs;
  • honouring offers, discounts, rewards or promotions shown or sent through ReVu;
  • training staff to use ReVu properly;
  • ensuring staff do not misuse customer information;
  • complying with POPIA, CPA, ECTA and other applicable laws;
  • ensuring Google Review requests comply with Google's rules and applicable law.

6. Customer review flow

A customer may use a ReVu-powered review link to:

  • enter a mobile number;
  • accept consent wording;
  • submit a rating;
  • submit private feedback;
  • check in for repeat visits or rewards;
  • continue to Google Reviews where applicable.

Low ratings may be captured privately so that the business can respond or improve service. Higher ratings may redirect to Google Reviews.

ReVu does not force customers to post a public Google review.

7. Google Reviews

ReVu may redirect customers to a Google Review page.

ReVu does not guarantee:

  • that a customer will write a Google review;
  • that Google will publish the review;
  • that Google will keep the review visible;
  • that Google ratings will improve;
  • that a business will receive a specific number of reviews;
  • that reviews will produce revenue.

Businesses must not use ReVu to generate fake, misleading, incentivised or unlawful reviews.

8. Loyalty, rewards and offers

Businesses may use ReVu to recognise repeat customers and offer rewards or promotions.

Unless expressly stated otherwise:

  • offers are provided by the relevant business, not ReVu;
  • the business is responsible for honouring its own rewards;
  • reward rules may depend on visit count, timing, availability, staff verification or business settings;
  • rewards may be changed or withdrawn where lawful and reasonable;
  • ReVu is not responsible for a business refusing a reward unless ReVu directly caused the issue.

9. SMS, WhatsApp and communication credits

ReVu may provide SMS, WhatsApp or communication credit features.

During private beta, credits may be manually loaded or fulfilled.

Credit orders may show as pending until payment is confirmed and admin fulfilment is completed.

Buying credits does not mean messages are instantly sent unless the relevant sending provider and campaign switches are active.

ReVu may disable live sending for safety, compliance, provider setup or private beta reasons.

Businesses must ensure marketing messages are lawful, accurate and not spam.

10. Payments, subscriptions and trials

ReVu may offer free trials, subscriptions, setup services, hardware, communication credits, add-ons or custom services.

Prices, features and billing cycles may be shown on the website, dashboard, invoice, proposal or agreed order.

Unless otherwise agreed:

  • subscription fees are billed monthly or as shown;
  • setup fees may be charged separately;
  • hardware may be charged separately;
  • third-party costs may be charged separately;
  • communication credits may be prepaid;
  • taxes may be added where applicable.

11. Trial accounts

If a trial is offered, it may be limited by time, features, usage, business count or platform settings.

At the end of a trial, access may be restricted unless the business chooses a paid plan.

ReVu may refuse, limit or cancel trial access where there is misuse, fraud, duplicate abuse or operational risk.

12. Estimated ReVu Impact and analytics

ReVu may display estimates such as:

  • estimated recovered value;
  • estimated review growth value;
  • estimated protected revenue;
  • recovery rate;
  • review velocity;
  • customer sentiment;
  • loyalty activity;
  • repeat visit activity.

These figures are estimates only.

They are not guaranteed revenue, accounting records, tax advice, financial advice, proof of sales or a promise of future performance.

Businesses should use these figures for general insight and decision-making, not as official financial statements.

13. Finance Hub

If Finance Hub features are available, they are intended to help ReVu administrators or authorised users record and organise internal business information.

Finance Hub outputs, exports, tax summaries and reports are for planning and review purposes only.

They are not official SARS submissions, audited financial statements, tax advice, accounting advice or legal advice.

A qualified accountant or tax practitioner should review financial records before formal submission or reliance.

14. Acceptable use

You may not use ReVu to:

  • break the law;
  • send spam or unlawful marketing;
  • upload malware or harmful code;
  • access another business's data;
  • attempt to bypass security;
  • reverse engineer the platform;
  • scrape, copy or misuse data;
  • impersonate another person or business;
  • upload false, harmful, defamatory or unlawful content;
  • collect unnecessary sensitive personal information;
  • create fake reviews;
  • interfere with the platform's operation.

15. Data protection obligations

Businesses must use ReVu in a manner that complies with data protection laws.

Businesses must:

  • obtain valid consent where required;
  • respect customer opt-outs;
  • use customer data only for lawful purposes;
  • avoid sharing login credentials;
  • protect staff and customer data;
  • notify ReVu of suspected unauthorised access or misuse.

16. Intellectual property

ReVu, the ReVu name, platform, design, software, dashboards, workflows, branding, icons, layouts, documentation, processes and related materials belong to ReVu Systems or its licensors.

Using ReVu does not give a user ownership of the platform or any ReVu intellectual property.

Businesses remain owners of their own logos, brand assets and content they upload, but grant ReVu permission to use those assets as needed to provide the service.

17. Confidentiality

Users may receive access to non-public information, including dashboard data, customer insights, platform settings, business performance information or beta features.

Users must not disclose or misuse confidential information.

18. Third-party services

ReVu may integrate with or redirect to third-party services such as Google, WhatsApp, SMS providers, email providers, payment providers, hosting providers and authentication providers.

Third-party services have their own terms, privacy policies, availability and pricing.

ReVu is not responsible for third-party outages, policy changes, rejected messages, failed payments, Google review filtering or third-party account restrictions.

19. Availability and support

We aim to keep ReVu available and working, but we do not guarantee uninterrupted access.

Access may be interrupted for:

  • maintenance;
  • updates;
  • provider outages;
  • internet issues;
  • security events;
  • errors;
  • force majeure events;
  • beta changes.

Support may be provided through email, WhatsApp, dashboard support request or another channel selected by ReVu.

20. Suspension and termination

We may suspend or terminate access if:

  • fees are unpaid;
  • the platform is misused;
  • there is a security risk;
  • a user breaches these Terms;
  • a business uses ReVu unlawfully;
  • continuing service may harm ReVu, customers, businesses or third parties.

A business may request cancellation or downgrade according to the applicable plan, billing terms and Refund Policy.

21. Disclaimers

ReVu is provided on an "as is" and "as available" basis to the extent allowed by law.

We do not guarantee:

  • more customers;
  • more revenue;
  • more Google reviews;
  • higher Google ratings;
  • customer retention;
  • delivery of every SMS or WhatsApp message;
  • uninterrupted availability;
  • that all analytics are exact;
  • that third-party platforms will behave in a particular way.

22. Limitation of liability

To the maximum extent allowed by law, ReVu Systems will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of revenue, loss of goodwill, loss of data, loss of customers or business interruption.

Where liability cannot be excluded, ReVu's liability will be limited to the amount paid by the business to ReVu for the affected service during the one month before the event giving rise to the claim, unless the law requires otherwise.

23. Indemnity

You agree to indemnify and hold ReVu Systems harmless from claims, losses, damages, fines, penalties, costs or expenses arising from:

  • your unlawful use of ReVu;
  • breach of these Terms;
  • unlawful marketing;
  • misuse of customer data;
  • false or misleading offers;
  • fake or unlawful reviews;
  • unauthorised account access caused by your failure to protect credentials;
  • your business's failure to comply with applicable laws.

24. Changes to the service

We may update, improve, modify, suspend or remove features from time to time.

Where changes materially affect paid services, we will try to give reasonable notice where practical.

25. Changes to these Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a new "Last updated" date.

Continued use of ReVu after updates means the updated Terms apply.

26. Governing law

These Terms are governed by the laws of the Republic of South Africa.
